Fair and Just Prosecution Applauds Prosecutors Standing Up to Federal Overreach and Defending Public Safety

Today’s launch of the Project for the Fight Against Federal Overreach is exactly the type of response needed to the urgent threats to public safety we have seen across the country. This national coalition of elected prosecutors committed to investigating and–where warranted–prosecuting federal agents who violate state criminal law represents leadership at its best and a clear affirmation of what public safety, prosecution, and the rule of law truly mean.

No one is above the law, including federal agents. When they exceed their lawful authority, independent local prosecutors have both the responsibility and the obligation to act. By coming together through this coalition, these prosecutors are stepping up to carry out that duty exactly as the system is designed to work.

Under the Supremacy Clause, federal agents are shielded from state prosecution only when their actions are authorized by federal law and objectively reasonable. That protection is not automatic or absolute. Determining whether it applies is the core responsibility of state and local prosecutors. That duty exists to protect constitutional rights, ensure transparency, and build public trust in law enforcement and the integrity of the judicial system. Efforts to interfere with investigations or intimidate prosecutors undermine the rule of law and put public safety at risk.

This coalition shows what it means to honor the oath prosecutors take to serve the public and defend constitutional rights. It is a clear statement that prosecutors work for the people, not for political power or federal command structures that have drifted out of step with the law. Prosecutors are not elected to protect injustice, obscure the facts, excuse abuses of power, or look the other way when constitutional rights are violated. They are elected to follow the law and seek justice, without fear, favoritism, or political pressure.
